Venezuela – Refuge in Venezuela, a Current

Three days before June 20, 2022, World Refugee Day, a new ODISEF context report gives us clues to understand what is the situation of international protection in Venezuela. For obvious reasons we make a great effort to follow up on the millions of people in Venezuela who have had to leave the country in search of protection and rights, but there is a risk of not making visible people who seek protection within Venezuela fleeing other causes. This report refers to the analysis of cases of Colombian people who, being in Venezuela, have accessed or could access refugee status, and raises awareness about their real situation of protection.

Traditionally, the right to asylum in Venezuela has had special relevance for Colombian victims of more than 50 years of armed conflict in that country. The body of law on Refuge and Asylum in Venezuela, from the constitutional framework to the different laws that develop it, have been enshrining the principles (no punishment, no refoulement, family unity...) and procedures recognized internationally and regardless of their nationality of origin.

It is a fact that Venezuela's own situation has reduced the conditions for a reception in accordance with the law and that offers real and effective protection, among the population that has fled Venezuela in recent years, there are also thousands of Colombians who had sought in Venezuela a space for protection.

And it is also true that thousands of others remain in the neighbouring country. But under what conditions, have they really accessed the protection mechanisms proposed by the Venezuelan legislation, and are they aware of these mechanisms?
